Terms And Conditions – Dreamshoots photography services

Please read the following booking conditions carefully as they set out the Terms and Conditions of the contract between you and all the persons named in your booking (herein referred to as “you” or “the customer”) and Dreamshoots Photography, license number 1099118 issued by Dubai Economy department (herein referred to as “Dreamshoots”, “we”, “us” and “our”).
Proceeding with a booking entails the acceptance of our terms and conditions for without the need of a signed contract agreement. A contract will exist as soon as you pay a deposit to us (or full payment, as applicable).
The “Photography Session” or “Photoshoot” referred to herein is the duration between when you are picked up from an agreed location before commencement of the photoshoot and dropped off to an agreed location after the experience.
Rates
We are mostly working with travellers who expressed their preference to use their own currency, therefore our rates are quoted in EUR (Euro) & USD (US Dollars). However prices in AED (United Arab Emirates Dirham) can definitely be provided upon request. Prices can be subject to change at any point of time at the discretion of Dreamshoots.Payment terms
Upon booking, a non-refundable deposit is due. The deposit secures the Photography Session date and time, as well as the Photography Session pricing, as of the date of payment of the deposit. If the customer fails to make the required deposit, prices are subject to change at the discretion of Dreamshoots and the Photography Session date and time will not be secured. The remaining payment is due in cash on photoshoot day.Transportation
The packages that include pick up and drop off are limited to hotels and residences based in the emirate of Dubai. Any pickup location that is located outside of Dubai is subject to extra transportation charges. You have the possibility to align on a meeting point located in the emirate of Dubai to avoid those extra charges. Our permission prior to pick up must be asked for the carriage of any person or item that is not related to the photoshoot.
Eating and drinking (except water) in our vehicles is prohibited.
We will through our best efforts provide car seats in case of child presence however please note that availability and adaptedness of the seats to the age of your child is not guaranteed.
Vehicles may be equipped with dashcam technology that records high-definition sound and video. Footage may be used for legal, insurance and training purposes and may be used to verify performance related questions, queries, or concerns.
Any customers with mobility concerns will need to inform us when completing their booking so we can advise if we can accommodate your booking and make any necessary arrangements. Depending on the nature of the disability, a private vehicle booking may be required. We reserve the right not to accept customers that have a disability on photoshoots due to safety concerns.Cancellation/rescheduling & refund policy
Due to the extensive organisation and limited capacity involved with our photoshoots, a strict non-refund policy is applicable to compensate for costs and lost revenue in case of cancellation by customers, regardless of the reason and notice.
You agree that if he or she is late to a session, such time will be deducted from the time allotted for the Photography Session.
We strongly recommend that you take out adequate travel insurance that will cover you in case of unforeseen circumstances that prevent you from joining your scheduled photoshoot. We will be more than happy to provide evidence to your insurance company if you were unable to join us.
If a photoshoot is not able to commence due to inclement weather before pickup, an alternate booking date will be offered, and a partial refund of the deposit (50%) is possible if mutual availabilities don’t match. If a photoshoot is not able to commence due to inclement weather after pickup, the deposit will not be reimbursed, to compensate for costs and lost revenue.
If we inform you of weather conditions prior to pick up and you decides to maintain the booking, you takes the entire responsibility of the consequences of the weather conditions on the photoshoot and the full payment will be due to Dreamshoots.
No refunds will be given in the event of any delay, curtailment or alteration of a photoshoot resulting from any cause including severe weather conditions. Desert photoshoots are weather dependent, and we cannot be held liable if the quality and result of the photoshoot is affected by the weather.
In the unlikely event of cancellation from us due to injury, illness, or any other reason beyond the reasonable control of the photographer, a full refund of the paid deposit is made.Child presence
In case of presence of children (0 to 12 years old) with the customer, we will charge a fee corresponding to “add your kids” add on. This fee is applicable whether the kids participate to the photoshoot or not.
Alcohol and drugs are expressly forbidden according to local law and any guest can be refused access to the tour at the discretion of the Guide, without refund, if suspected of being under the influence.For VISA or MASTERCARD usage
the customers using the website who are Minor /under the age of 18 shall not transact on the website. The cardholder must retain a copy of transaction records and Merchant policies and rules. Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the UAE. We accept payments online using Visa and MasterCard credit/debit card. Refunds will be done only through the Original Method of Payment. We will NOT deal or provide any services or products to any of OFAC sanctions countries in accordance with the law of the UAE.
Your pictures will be sent in JPEG format via an online link.An extra charge is applied if you request to receive the RAW files.
In case of group bookings, the photos of all group members will be sent in one folder.
If the package that you purchased includes editing, you must communicate the references of the photos to be edited before the deadline communicated by Dreamshoots. Once the deadline is expired, the edits will be charged, and payment will be requested upfront.
Our professional editing service is based on common needs and cannot be customized by the customer.
The turnaround time of edits may vary based on our workload and shall not exceed 1 month from the date of reception of your selection. In case of group bookings, the edits will start once all group members submit their selection and all edited photos will be shared on the same date. Once the edited photos will be shared, you will have a period of 48 hours to download all the content shared with you (non-edited and edited). After 48 hours, all the content will be deleted from the link.
We will keep a copy in our archive of your edited photos only, for a period of 6 months after sharing them with you. In case of request from your end to receive them one more time, a fee will be charged.Copyright
You agree that he or she has the authority to agree to the use of the likeness of all individuals to be photographed during the Photography Session. You agree and assign Dreamshoots the irrevocable and unrestricted right to alter, use and publish all images taken during the photography session for advertising, display, publication, and all other marketing and/or educational purposes. You agree to release all claims or right to any profit that may be generated for the use and publication of the same. You further agree to indemnify and defend Dreamshoots for all claims, demands, or lawsuits made in relation to our use of the images as contemplated by this paragraph. We retain the exclusive copyright protection for all images taken during the photography session. You may not, without the express written permission of Dreamshoots, use the images taken during the photography session for professional display, profit, or other commercial endeavours. All images displayed on our websites are subject to the protections of this paragraph. For all purchased images, the Photographer grants the Client permission to share the purchased images with family, friends, and on social networking websites so long as the images remain unaltered and textual credit as provided by the Photographer.Release of liability
Whilst we make every effort to safeguard our passengers, to the maximum extent permitted by law, we accept no responsibility for any damage, loss, accident, sickness, injury, or death that you or anyone else may suffer or incur arising out of the tour and/or in connection with your booking with us. All personal effects are at your sole risk at all times during the photoshoot.
Our photoshoots require a reasonable level of fitness. Pregnant ladies are taking the entire responsibility of any injuries, damages, or other losses that may occur directly or indirectly as a result the Photography session and hereby defer all liability from us.Governing Law and Jurisdiction
Any dispute or claim arising out of or in connection with your booking with us shall be governed and construed in accordance with the laws of UAE.
By booking your photoshoot, you and/or your companions confirm that you have all fully understood and accepted these Terms and Conditions.
